The Broadcasting Authority has accepted the court ruling over its action regarding a Radio Television Hong Kong television programme.
The authority reviewed the May 8 case and has decided not to appeal against the court's ruling.
The case stemmed from RTHK's Hong Kong Connection - Gay Lovers programme in July 2006, which saw 22 complaints. The authority issued a strong advisory to RTHK for breaching the Codes of Practice concerning impartiality and family viewing hours.
However, in a judicial review the court ruled the authority misunderstood its own code. The authority said while it respects the ruling it takes a different view in applying the "due impartiality" provision.
The authority said it is mindful of setting standards of content regulation which reflect social values. It will seek feedback in drawing up the code and has engaged a university to conduct a study on the use of language in broadcasting.
