Factory marking scheme to launch

A marking scheme on tenancy-related offences leading to eviction will be introduced in June-July in Housing Authority factory estates.

 

The proposed Factory Marking Scheme for Tenancy Enforcement in Factory Estates covers offences committed by tenants, operators and employees. It defines a number of offences relating to tenancy abuse, building control, environmental hygiene or public safety, to which points will be allotted according to the degree of seriousness.

 

Obstructing or unauthorised occupation of corridors or common areas, and denying the landlord entry for inspection and repair will each lead to a deduction of five points. Storage of excessive dangerous goods, unauthorised installations and structures, using factory unit for food factory purpose, as well as conversion of factory unit into domestic use will each lead to a deduction of seven points.

 

2-year allocation

Points accumulated will be valid for two years and will be cleared only upon expiry of the validity period. Tenants will be alerted once the accrued points reach 10 or more.

 

Tenants allotted with 16 points accumulated over a two-year period will be served a notice to quit to terminate the tenancy. The Housing Department will consider all relevant circumstances in deciding whether to issue the notice, and tenants may appeal as with all tenancy terminations.

 

The marking scheme is an administrative measure introduced to enhance tenancy enforcement. The statutory rights and obligations of the landlord and tenant under the existing tenancy will not be affected. In addition to tenancy actions, sanctions by other enforcement departments and licensing authorities will continue.
