The Government respects the High Court’s decision against granting an interim injunction sought by the Secretary for Justice to prevent two new legislators from retaking their oaths of office in the Legislative Council.
Chief Secretary Carrie Lam made the statement today, adding the Secretary for Justice has applied for a judicial review over LegCo President Andrew Leung’s decision to allow the pair to retake their oaths because the Government has legal grounds.
She said legislators have obligations under the Basic Law to swear allegiance to the Hong Kong Special Administrative Region of the People’s Republic of China upon assuming office, noting that corresponding action is required to deal with non-observance of such obligations.
She also dismissed suggestions the Government sought to block the pair from taking office through legal means, adding society may not trust legislators who do not comply with legal requirements in taking oaths.
