Legal aid pilot scheme to start

A 12-month pilot scheme on legal aid for mediation in matrimonial cases will be launched on March 15.

 

The Legal Aid Department said today the scheme was launched in light of the final report of the Working Party on Civil Justice Reform in March 2004, which recommended the department have the power to fund mediation, alongside its ability to fund court proceedings, in suitable cases.

 

The cost-effectiveness and the implication of extending legal aid to mediation in matrimonial cases will be assessed in the trial.

 

Matrimonial mediation

Under the scheme, legally-aided persons in matrimonial cases who are willing to attempt mediation to resolve any dispute with the other parties will be referred to the Judiciary's Mediation Co-ordinator's Office.

 

It will provide information sessions for the parties concerned, and assess whether the cases are suitable for mediation. If a case is suitable, the office will assist the parties choose a mediator.

 

Participation in the scheme is voluntary and the department will pay for mediator fees.

 

The department aims to complete an evaluation of the scheme's outcome in 2007-2008.
