6 charged for tendering fraud

The ICAC has charged six people for allegedly defrauding the Housing Authority by evading the tendering process for the supply of metallic gates for housing projects.

 

The defendants are William Chan, 56, and Wong Chun-hay, 49, respectively the director and manager of Dynamic Mark; Yu Chuen-wing, 53, director of Hip Tat Engineering Company; Hui Shun-tang, 45, director of Tien Shan Engineering; Law Chung-for, 40, director of Sheen Harvest Industries; and, Sit Kam-tai, 54, director of Shing Shun Engineering Factory.

 

They will appear in Eastern Magistracy tomorrow morning to face a count of conspiracy to defraud.

 

At the time of the alleged offence, Dynamic, Hip Tat, Tien Shan, Sheen Harvest and Shing Shun were gate suppliers approved by the authority.

 

The charge alleges that between April 2, 1997 and September 13, 2000, the defendants conspired together to defraud the authority by dishonestly:

* submitting non-genuine quotations for the supply of gates to be incorporated into tenders to the authority for the purpose of evading and defeating the authority's tendering system;

* deceiving the authority into accepting the non-genuine quotations in such tenders; and,

* distributing equally amongst the gate suppliers the profits earned as a result of the authority accepting the tenders with the non-genuine quotations.
