Air carriage liability limits to be raised
*

A notice will be gazetted December 11 raising the limits of liability on the carriage of passengers, baggage and cargo specified in the Convention for the Unification of Certain Rules for International Carriage by Air (the Montreal Convention) from December 30.

 

To tie in with the revised limits the convention specifies, the liability limits specified in the Carriage by Air Ordinance Schedules 1A and 3 will also be revised correspondingly to the same level and become effective on the same date.

 

The revisions are:

* raising the first tier of liability limit for each passenger for damage sustained in case of death or bodily injury of a passenger from 100,000 to 113,100 Special Drawing Rights;

* raising the liability limit for each passenger relating to damage caused by delay in the carriage of people from 4,150 to 4,694 Special Drawing Rights;

* raising the liability limit for each passenger in case of destruction, loss, damage or delay relating to the carriage of baggage from 1,000 to 1,131 Special Drawing Rights; and,

* raising the liability limit in case of destruction, loss, damage or delay relating to the carriage of cargo from 17 to 19 Special Drawing Rights per kilogram.

 

The Transport & Housing Bureau said today according to the convention, the limits of liability are reviewed every five years based on a built-in mechanism, under which the limits will be revised if an inflation factor exceeds 10%. A recent review showed the inflation factor is 13.1%.
