The Intellectual Property Rights and Custodian of Rights under Clause Eight of the sponsorship agreement between the Government and the American Chamber of Commerce for HK Harbour Fest mainly refer to the actual "Harbour Fest" brand name.
They also refer to the one-hour TV special to be produced for broadcast in the US, and other recorded programmes that may be produced.
The TV special, which is not for profit-making purposes, will also be made available to other TV networks at nominal cost for worldwide broadcast.
Any revenue generated from the video or other products relating to festival will be used to offset its costs.
Regarding Custodian of Rights, in accordance with the Fifth Schedule and Clause Six of the contract, AmCham must submit the festival's audited accounts to the Government no later than February 28.
The Government and AmCham do not expect any further significant revenue to accrue from the festival after that time.
In the unlikely event there are revenues generated after the submission, these (after audit) will be added onto the already audited revenue of the festival as and when they arise until the end of 2008, which is the end of the custodian period.
Each time subsequent audited revenue is added to the accounts, the Government sponsorship fee will be re-calculated based on the audited revised total revenue and the audited total expenditure of the festival.
