Restaurant director Chan Wing-fai has been jailed one month after the High Court approved his application to abandon his appeal against his sentence for wage offences today.
He was the first company director to serve a jail sentence for wage offences.
Chan's company operated and closed three restaurants consecutively at the same premises at Mei Foo Sun Chuen from August 2003 to April 2004, without clearing wages. The employees turned to the Protection of Wages on Insolvency Fund for relief.
The Labour Department prosecuted Chan as evidence indicated the offences were committed with his consent or connivance.
The case was first heard at Kowloon City Magistracy on February 22, and Chan was given a one-month jail sentence, suspended for two years.
The department sought legal advice from the Department of Justice, which decided to apply for a sentence review. An immediate custodial sentence was subsequently imposed. Chan then applied to appeal against the sentence, but abandoned it today.
