Secretary for Justice Rimsky Yuen said today that the Basic Law should be adhered to when dealing with national security issues.
He was responding to reporters' questions this morning on the Central Government publishing its second draft of national security laws, which had mentioned Hong Kong.
Mr Yuen noted the SAR does play a certain role in national security, but stressed the Hong Kong and Mainland legal systems are different and that enacting security laws under Article 23 of the Basic Law would be preferable to unilaterally adding them to Annex III of the Basic Law.
He stressed that the new national security law would still have to go through the local legislative process to be applied, adding that it is only a draft and the legislative procedure is not completed yet.
